The Court of Appeal sitting in Abuja have delivered a judgement on Appeal nos: CA/ABJ/724/2033 and CA/ABJ/1169/2023. Between Victor Oye vs Otumba Camaru Lateef Ogidan & 2ors by Hon. Justice U Onyemenam- JCA.


In her ruling, the Hon Justice resolved all the reliefs sort in both appeals by the appallant(Victor Oye) in favour of the respondents. The court resolved the following:


1. That the trial judge has an unfettered jurisdiction to hear the case.

2. That Chief Victor Oye disobeyed the orders of the court by conducting an illegal congresses and national convention against the orders of the court.

3. That the Owerri Convention was valid and Chief Edozie Njoku was properly and legally elected as the National Chairman of APGA.

4. That the Contempt Judgement against Chief Victor Oye and Mahmood Yahaku at the lower court was in Order and must be acted on

5. That the judgement obtained by Chief Victor Oye from Anambra state  high court from Justice Ozor was Fraudulent, illegal,forum shopping and abuse of Court processed and is complete thrash

6. That justice M.A Madugu of the FCT high court was right declaring that Chief Edozie Njoku should be recognized as the national chairman of apga as decided by the supreme court.

7. That M.A Madugu was right in declaring that Chief Victor Oye should vacate the National Secretariat for Chief Edozie Njoku to occupy as the rightful National Chairman.

8. That justice M.A Madugu's declaration that Chief Edozie Njoku should be recognized by Inec stands.

9. That the declaration that all the actions  taken by Chief Victor Oye and Mahmood Yahaku in conducting congresses, convention, primaries, meetings or flag off of campaign of any kind is Illegal, Fraudulent,null and void.

10. That Chief Victor Oye and Mahmood Yahaku are liable to be sentenced to prison for disobeying the orders of the court unless they purge themselves.

11. That both Chief Victor Oye and Mahmood Yahaku are in contempt of the court.
